A legal dispute involving a surrogate mother, a California couple, and a newborn with a heart condition has reached the United States Supreme Court.

McKenna West, a nurse from Alaska, entered a surrogacy contract with Omar Ahmed and Nausheen Gilkar of California. During the twentieth week of pregnancy, an ultrasound revealed the fetus had hypoplastic left heart syndrome, a condition requiring life-saving surgeries. The intended parents requested that West terminate the pregnancy, but she refused. In response, the couple's lawyers threatened West with six-figure penalties and filed a lawsuit in Alaska for damages.

West fled to Texas with her two children to avoid the legal pressure and to access medical care. She chose Texas because the state prohibits abortion and recognizes the legal significance of childbirth. West also sought a hospital in Dallas that she stated offers a 100 percent survival rate for the Norwood procedure, the first surgery required for the infant. The baby, whom West named Gabriel, was born in Dallas on August 12.
