USCCB files new brief in Supreme Court case involving Colorado Catholic preschools (USCCB)

The United States Conference of Catholic Bishops filed a 27-page brief supporting a Denver Catholic parish and other plaintiffs in a Supreme Court case regarding Colorado’s universal preschool program. The brief, dated July 2026, was prepared by attorneys from Lehotsky Keller Kohn.

The case involves a dispute with the Colorado Department of Early Childhood, which excluded Denver archdiocesan schools from the preschool funding program. According to the Becket Fund, the state claimed the Archdiocese’s requirement that enrolled families support and uphold Catholic teachings was inconsistent with program rules regarding sexual orientation and gender identity.

The 10th Circuit Court of Appeals previously ruled in favor of the state, but the Supreme Court has agreed to hear the appeal from the plaintiffs. This new filing follows an earlier 21-page brief submitted by the USCCB in December 2025.
